Speak2Win Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Speak2Win virtual reality application ("Speak2Win" or the "App") developed and operated by Winfinity LLC ("we," "us," or "our"). By downloading, installing, or using Speak2Win, you agree to be bound by these Terms.
If you are under the age of 18, your parent or legal guardian must read and consent to these Terms before you use the App.
1. About Speak2Win
Speak2Win is a VR training application designed to help users practice and improve public speaking skills through immersive virtual audience simulations. The App is available on the Meta Quest platform and requires compatible Meta Quest hardware.
2. License to Use
Subject to your compliance with these Terms, Winfinity LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use Speak2Win for your personal, non-commercial training purposes.
You may not:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Use the App for any commercial purpose without our written consent
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Use the App in any way that violates applicable laws or regulations
3. Meta Quest Platform
Speak2Win is distributed through the Meta Quest Store. Your use of the Meta Quest platform, headset, and related services is governed by Meta's own Terms of Service and policies, which are separate from and independent of these Terms. We are not responsible for Meta's platform, hardware, or services.
4. VR Health & Safety
Virtual reality experiences can cause discomfort, disorientation, or motion sickness in some users. By using Speak2Win, you acknowledge that:
- You are responsible for ensuring you are in a safe physical environment before using the App
- You should take regular breaks during extended VR sessions
- You should stop using the App immediately if you experience discomfort, dizziness, or nausea
- Winfinity LLC is not liable for any physical injury or discomfort arising from VR use
5. User Content & Performance Data
Speak2Win may record and store your in-app performance data, including session history, speech metrics, and progress scores, to power the coaching and feedback features. This data is governed by our Privacy Policy.
You retain ownership of any content you create within the App. By using the App, you grant Winfinity LLC a limited license to process your performance data solely to provide and improve the App's features.
6. Intellectual Property
All content, features, and functionality of Speak2Win — including but not limited to the software, virtual environments, audience simulations, coaching algorithms, graphics, and audio — are owned by Winfinity LLC and protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
7. Disclaimers
Speak2Win is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or meet your specific requirements. VR-based training is a supplement to — not a replacement for — professional coaching or real-world practice.
8. Limitation of Liability
To the fullest extent permitted by law, Winfinity LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Speak2Win, even if we have been advised of the possibility of such damages.
9. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Florida.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Continued use of Speak2Win after changes are posted constitutes your acceptance of the revised Terms.
